
So, prosecutors don't have enough evidence to charge James Halstead with drugging Pasha Grishuk with the intent to rape her. Seriously, this is an issue 90% of the time and part of why our system doesn't work. It works in many ways, but trust me, prosecutors will not charge someone with anything unless they know they can win a guilty verdict. We had written confessions in my case, for example and still a messy dogfight, right?
This is why civil remedy can be a good thing, given it's lesser standard of proof. Also, I always say let a Grand Jury decide - however, what most folks don't understand is how expensive it is to convene a Grand Jury, so we have a chicken/egg situation. They don't care a whit about conviction rates or reelection. It's sort of like the "Italian Grandma spaghetti test". Throw enough against the wall and some will stick.

UPDATE: Okay, are we going down this road again, where real victims don't get justice because of the false reporters? It needs to end - the media just wants to turn on real victims and commenters will pull apart those who need help. And those of you who have been victims, please stop your silence and report. We're getting it all wrong.

I agree withyou 100%.I know this story all too well. Such was my situation, I could and should write the book. The legal system makes you go through all this he said she said bull shit just to make you feel like they are doing their job. Then they sorry, your word against his, nothing we can do because if we can't convict, tough shit. Not worth our time...
Until he does it to someone else, as was the case with Alex Kelly, and as was the case with me. I was just too chicken shit to go to the Katie Couric's of the world and speak out.
Then, presto- we need you to testify. He did it again. Really? I am so surprised!!! Can Robert Morgenthau blow out my candles on my birthday cake?

I hear you! The system does have its drawbacks, but really seems to be broken when it comes to sexual assault, rape, incest, etc. That said, without testifying it's obvs impossible to convict.
Can I just say, your Morgy comment totally made me laugh?!
However, just read the bottom of the post. Methinks Pasha (see the link) was not truthful, which should make us mad - no jury wants to convict someone whose accuser may or may not be lying.
This is the bigger problem and it's not getting any better. The media doesn't want to here about the real stories - they want to perpetuate the whiff that an accusing witness may be lying.
